Public procurement is a very dynamic area of law that requires an interdisciplinary approach of various experts and continuous education. Recent changes of the Public Procurement Law stipulate that from January 1, 2010. contracting entities are obliged to use services of at least one person who has completed Public procurement training program in preparing the tendering documentation and procedure if the contracts have a value (excluding value-added tax-VAT) estimated to be no less than HRK 300.000 in the case of supply and service contracts and HRK 500.000 in the case of works contracts. Furthermore, small and medium companies (who are often tenderers and candidates in public procurement) usually do not employ employees who are specialized for public procurement procedure which means that it is likely that they will not be able to perceive possible breaches of Public procurement Law. Due to that fact it is possible they will have problems in preparing tendering documentation or that they will not use their right to appeal.
